MOFA Statement : Illegal activities of former UN Permanent Rep. of Myanmar

The Ministry of Foreign Affairs issued the statement regarding the illegal activities of Kyaw Moe Tun, who has already been dismissed as Myanmar's Permanent Representative to the United Nations.

Kyaw Moe Tun was dismissed from civil service with effect from 27 February 2021 for failing to comply with orders and directives issued by the State, committing acts of treason against the State in violation of diplomatic ethics, and acting in allegiance to and as a representative of unlawful organizations.

Despite his dismissal from civil service, it has been found that Kyaw Moe Tun continues to use state-owned property, including the premises of the Permanent Mission of Myanmar in New York, the official residence of the Head of Mission, and a vehicle.

Furthermore, it has been learned that, as of February 2021, the funds amounting to  2.76 million USD and 38,233.62 EUR remained in the bank account of the Permanent Mission of Myanmar to the UN in New York. It has also been found that these remaining State funds were withdrawn and used without authorization from the State and were misused for personal interests.

Therefore, Kyaw Moe Tun will be required to explainthe use of the mission’s funds and provide supporting evidence. Furthermore, Kyaw Moe Tun has been in direct contact with the NUG and CRPH, which have been declared unlawful associations and terrorist organizations, and continues to act as their loyal representative.

He has misused the UN platform and served as a political tool for the so-called NUG by creating a false appearance of legitimacy online and facilitating the collection of donations for the NUG.

Moreover, he actively acts as an accomplice to terrorist acts by concealing, defending, and supporting unlawful violent operations targeting innocent civilians, civil servants, and public infrastructure within Myanmar on the international stage. In connection with these acts, the Dekkhina District Court instituted Case No. 32/2021 against Kyaw Moe Tun under Section 122(2) of the Penal Code for high treason against the State, and issued an arrest warrant against him.

Furthermore, action has been taken against him under Section 17(1) of the Unlawful Associations Act, Section 6(1) of the Public Property Protection Act, and Section 124-A of the Penal Code. Additional legal proceedings have also been instituted against him under the Counter-Terrorism Law and Section 66(d) of the Telecommunications Law.

At present, Kyaw Moe Tune has been declared a proclaimed offender under Sections 87 and 88 of the Code of Criminal Procedure, and court orders have been issued accordingly.

Through INTERPOL and the United States National Central Bureau (USNCB), efforts continue via diplomatic channels, in cooperation with the Myanmar Embassy in Washington, D.C., to coordinate with relevant United States law enforcement authorities for the necessary action.

In light of Kyaw Moe Tun’s activities, including misuse of government funds and state-owned property, communications and activities with unlawful organizations, and use of the United Nations platform to propagate one-sided accusations as instructed by the opposition, questions have arisen about his personal credibility and his authority to represent Myanmar.

Kyaw Moe Tun's continued representation of Myanmar at the United Nations does not constitute formal recognition of his legitimacy. Rather, his continued status is merely a temporary arrangement, with the Credentials Committee’s decision deferred annually.

Therefore, the Ministry of Foreign Affairs informs the United Nations, the international community, and all governments maintaining diplomatic relations with Myanmar that Kyaw Moe Tun’s status as a representative of Myanmar has been revoked and withdrawn. Furthermore, statements and acts of incitement by Kyaw Moe Tun do not represent the Government of the Republic of the Union of Myanmar and/or the people as a whole.
