Constitutional Tribunal of the Union: State of emergency extended in conformity with Constitution

According to the current situation, it is not the time yet to report that the Commander-in-Chief of the Defence Services has accomplished the duties assigned to him under Section-426 of the Constitution.

Moreover, it is an extraordinary situation so that the extension of the duration shall continue, under Section-425 of the Constitution. Concerning the continual extension under Section-425, the Pro Tem President asked suggestion from the National Defence and Security Council whether the prescribed duration for another  six months was in conformity with the State Constitution. Based on the terms and phrases of Constitution of the Republic of the Union of Myanmar, it was an extraordinary situation so that it requires extension of the prescribed duration for a term of six months starting from 1st February 2023. 

Therefore, the Constitutional Tribunal of the Union submitted its statement to the Pro Tem President that the extension of the state of emergency was in conformity with the State Constitution, on 31st of January 2023.
