






Oral hearings regarding the case between The Gambia and Myanmar are being conducted from January 12 to January 29 at the International Court of Justice (ICJ) in The Hague, Netherlands. Following the first round of Myanmar’s oral arguments on January 19 (from 10:00 AM to 6:00 PM local time), lead counsel Mr. Christopher Staker and counsels Mr. Sam Bloom-Cooper and Ms. Leigh Lawrie delivered their respective rebuttals.
The legal proceedings continued with the arguments presented by Myanmar’s legal team including Mr. Stefan Talmon rebutted The Gambia’s allegations that the Government or the Tatmadaw orchestrated the dissemination of hate speech to oppress Bengalis, which The Gambia argued demonstrated "genocidal intent", Ms. Alina Miron addressed and countered allegations regarding an alleged failure to punish perpetrators and the supposed destruction of evidence, Mr. Sam Bloom-Cooper argued against the allegation that Myanmar had failed to fulfill its "burden of proof" responsibilities, Ms. Alina Miron (further arguments) responded to The Gambia’s accusations that Myanmar failed to prevent genocide, failed to punish those responsible, and failed to enact necessary legislation and Mr. Stefan Talmon (further arguments) rebutted the subsequent legal claims and requests for reparations submitted by The Gambia. These comprehensive legal rebuttals were formally presented to the Court.
