
Leader of the Information Team of the State Administration Council Maj-Gen Zaw Min Tun made clarification on the transfer of sovereign power of Pro Tem President to the SAC Chairman.
He explained that the transfer of sovereign power of Pro Tem President has been made in line with the Constitution Section-412 (b), highlighting that “If all the members are unable to attend the meeting held by the President to coordinate with the National Defence and Security Council under Sub-Section (a), the President may declare in time a state of emergency after coordinating with the Commander-in-Chief of the Defence Services, the Deputy Commander-in-Chief of the Defence Services, the Union Minister for Defence, and the Union Minister for Home Affairs who are members.
The said declaration shall be submitted to the National Defence and Security Council for approval as soon as possible.” When the Pro Tem President is vacant due to various circumstances, the Commander-in-Chief of the Defence Services, who is leading the National Defence and Security Council, shall have the right to exercise the powers of legislature, executive and judiciary according to Section-419.
According to Section 431, it also stated that “The National Defence and Security Council shall exercise the sovereign power in the name of the President.” For the legislature, executive and judiciary, the State Administration Council and the government will take responsibilities as per Section-419.
Accordingly, the SAC and the Government will keep on implementing the 9 objectives and 5-point Road Map while striving to hold free and fair multi-party democracy general election.
