




Union Chief Justice U ThaHtay attended the 12th International Legal Forum of the Asia-Pacific Region, which was organized by the Supreme Court of the Russian Federation through video conferencing on Thursday.
The Chief Justice of the Supreme Court of the Russian Federation made his welcome speech. Then, the Union Chief Justice U ThaHtay, the Chief Justices of the Asia-Pacific Region and the Heads of Delegate delivered speeches respectively. The Forum consists of two sessions included the topics of Cross-Border Legal Relations and National Justice and Protecting the Rights of the Business in a Social Welfare State: Balance of Interests in Judicial Practice. Supreme Court of the Union Justice U Thaung Naing took part in the session of the Forum under the title of “Protecting the Rights of Business in Myanmar; the Role of the Judiciary”.
In his discussion, Justice U ThaungNaing said there are core values of legal framework in Myanmar to develop the rights of the business both for internal and external investors. Under section 36 of the Constitution of the Union, the Government guarantees to protect and prevent acts that injure public interests through monopolization or manipulation of prices by an individual or group with intent to endanger fair competition in economic activities.
There are many other laws regarding with the protecting rights of the business in a social welfare state, including Myanmar Company Law, Myanmar Investment Law, Competition Law, Insolvency Law, Arbitration Law and Trade Mark law etc. He added that the Supreme Court of the Union has adopted judicial strategic plans and has been implementing in line with the Myanmar Sustainable Development Plan (MSDP) to ensure the commitment of judiciary to people, with the slogan of “Providing Justice by All”. He emphasized that policy makers and the authorities concerned should be working together with judiciary to protect the Rights of the Business.
